These Terms of Service (“Terms”) are a legal agreement between you (“you” or “User”) and ARTEFAC INC. (“we,” “us,” or “our”), the company that operates ForRestaurants.ai. By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

ForRestaurants.ai is an AI-powered video creation platform that allows restaurants, cafes, food trucks, bars, and other food businesses to generate short-form marketing videos for TikTok, Instagram Reels, Facebook Reels, and YouTube Shorts using uploaded photos and optional selfies.

The Service is available via our website at forrestaurants.ai, our Android app, and our iOS app.

2. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into this agreement. The Service is intended for business use by food and restaurant operators.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits, Plans, and Payments

The Service operates on a credit-based system. Each video render consumes one credit. Credits are included in your monthly subscription plan or can be purchased separately.

  • •Free tier: One free video credit upon registration. No credit card required.
  • •Paid plans: Monthly subscription plans (Pro, Elite, Premium) are billed in advance. Credits included in your plan do not carry over to the next billing period unless otherwise stated.
  • •Billing: Payments are processed securely by Stripe. By providing payment details, you authorize us to charge your payment method for all applicable fees.
  • •No refunds: All purchases are final. We do not offer refunds for unused credits or partial subscription periods. If you believe a charge was made in error, contact us within 7 days at [email protected].
  • •Price changes: We may change our pricing at any time. We will give you at least 30 days' notice before a price increase takes effect for existing subscribers.

5. Your Content

You retain full ownership of all photos and other materials you upload to the Service (“Your Content”). By uploading Your Content, you grant ARTEFAC INC. a limited, non-exclusive, royalty-free licence to use, store, process, and display Your Content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • •You own or have the necessary rights to all content you upload.
  • •Your Content does not infringe any third-party intellectual property, privacy, or other rights.
  • •If your upload includes a person's likeness (e.g., a selfie or photo of staff), you have that person's consent to use their image in a marketing video.
  • •Your Content does not contain anything unlawful, defamatory, obscene, or otherwise objectionable.

6. Your Videos

Videos rendered by the Service using Your Content are owned by you. You may download, post, share, and monetize your rendered videos freely. You do not need to credit ForRestaurants.ai, though we appreciate it.

Rendered videos are stored on our servers for 90 days from the date of creation. After 90 days, they are permanently deleted. Download your videos before then.

7. Acceptable Use

You agree not to use the Service to:

  • •Create content that is false, misleading, defamatory, or deceptive.
  • •Infringe the intellectual property rights of any third party (e.g., uploading photos you do not have rights to).
  • •Upload content that contains nudity, violence, hate speech, or illegal material.
  • •Attempt to reverse-engineer, copy, scrape, or exploit any part of the Service.
  • •Use automated tools (bots, scripts) to access the Service without our written permission.
  • •Circumvent any usage limits, security features, or access controls.
  • •Resell or sublicense access to the Service without our written permission.

8. Our Intellectual Property

All software, templates, design elements, AI models, branding, and other materials that make up the Service are owned by ARTEFAC INC. or its licensors. Nothing in these Terms grants you any rights to our intellectual property other than the right to use the Service as described herein.

“ForRestaurants.ai,” the ForRestaurants logo, and related marks are trademarks of ARTEFAC INC. You may not use them without our prior written permission.

9. Third-Party Platforms

Videos you create are intended for posting on third-party platforms such as TikTok, Instagram, Facebook, and YouTube. Your use of those platforms is governed by their own terms of service. We are not responsible for any decisions those platforms make regarding your content, including removal, demonetization, or account suspension.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or that videos will perform in any particular way on social media platforms. Results vary based on your content, posting strategy, and platform algorithms.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARTEFAC INC. AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ARTEFAC INC., its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

13. Termination

You may cancel your account at any time through account settings or by emailing [email protected]. Cancellation takes effect at the end of your current billing period. Unused credits are forfeited upon cancellation.

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or for any other reason with reasonable notice. Upon termination, your right to use the Service ends immediately and your data will be deleted per our Privacy Policy.

14. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at [email protected]. If not resolved within 30 days, disputes shall be submitted to binding arbitration in Toronto, Ontario, Canada, under the rules of the ADR Institute of Canada, except that either party may seek injunctive relief in a court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will notify you via email at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
